Celtic Holiday's Terms and Conditions


OUR AGREEMENT

1.  Your contract is with Celtic Line Travel Ltd (registered compnay no. 01336045), the fully bonded holder of ATOL 1772 issued by the CAA.

ALTERATIONS BY YOU

2.  We reserve the right (i) to charge an administration fee of £20 per person if you wish to change a confirmed booking and (ii) to treat any change requested less than 2 months before departure as a cancellation subject to the cancellation charges set out in paragraph 3 below.

CANCELLATIONS BY YOU

3.  Cancellation must be made in writing by the person who signed the booking form, the table below show the cancellation charge as a percentage of the total holiday cost, the charge depending on how many days before departure the writen cancellation is received at our office:

If the cancellation is covered under the terms of an insurance policy you may be able to relcaim these changes.

The deposit on bookings are £100 Menorca and £250 for all other destinations.

ALTERATIONS BY US

4.  Although it is unlikely that we will need to make changes to your holiday unless they are imposed on us by schedule alterations, we reserve the right to do so subject to complying with the conditiones herein set out.  Most such changes would be minor and will be notified to you as quickly as possible.  If a major change (such as alteration of flight departure or return by more than 12 hours) occurs (unless caused by force majeure - see below) you will have the choice of accepting the change, taking another available holiday from us or cancelling your holiday and receiving a full refund.  In all cases we will pay compensation as detailed below.

Important note: compensation will not be payable if we are forced to cancel or in any way change your holiday due to war, threat of war, riot, civil strife, industrial dispute, fire, adverse weather conditions or other circumstances amounting to force majeure.  Our brochure describes as accurately as possible the locations and accommodation we offer.

CANCELLATION BY US

5.  We reserve the right in any circumstances to cancel your holiday.  Howeverm in no case will we do so less than 2 months befoore the scheduled departure date except for reason of force majeure or failure on your part to pay the final balance.  If we are unable too provide the holiday booked we will return to you all monies paid or offer an alternative holiday of comparab;e standard and, if cancellation occurs within six weeks of departure, compensation on the same scale as in paragraph 4 above.

COMPLAINTS

6.  If you have a problem during your holiday, please inform our representative or villa staff immediately who will try to put things right.  If your complaint cannot be resolved locally, you must report the details to us within 28 days of your return home by writing to our office.  It is a condition of the contract that you report any problem whilst your in resort, if you fail to follow this procedure we cannot accept responsibility as we will have been deprived of the opportunity to investigate and rectify the problem.

PRIICING & SURCHARGE POLICY

7.  The price of your holiday is guaranteed against currency and fuel surcharges.  If however costs are increased by government action the costs of such will passed on to the client.

8.  Any payment made by the client to a travel agent in respect of a booking with Celtic Line Travel Ltd is held by the agent on behalf of the client until the agent receives confirmation of the bookings from Celtic Line Travel Ltd.  Thereafter any money held by the travel agent in respect of the booking is held on behalf of Celtic Line Travel Ltd.

9.  Celtic Line Travel Ltd reserves the right to reduce or increase the prices of holdiays in the brochre at various times in order to make special offers which may be advertised in national press.

LIABILITY

10.  In accordance with European Union regulation we accept responsibility for ensuring your holiday is supplied as described in this brochure and the services offered reach a reasonable standard.  If any part is not provided as promised we will pay you appropriate compensation if the enjoyment of your holiday has been affected.  We accept responsibility for the acts and or omissions of our emplyees or agents together with our suppliers except where they lead to death, injury or illness.  Our liability in all cases shall be limited to a maximum of twice the invoiced cost of the holiday.

11.  We accept responsibility for death, injury or illness caused by the neglient acr and or omissions or our emplyees or agents together with our suppliers and subcontractors, and or agents of the same whilst acting within the scope of, or in the course of, their emplyment in the provision of your holiday.  We will accordingly pay to our clients such damages as might have beed awarded in such circumstances under English law.

12.  In respect of carriage by air and sea and the provision of accommodation our liability in all cases will be limited in the manner provided by the relevant international convention.  When you travel with the carrier, the conditiones of carriage of that carrier apply, some of which may limit liability.

13.  If any clients, siffers death, illness or injury whilst overseas arising out of an activity which does not form part of the foreign inclusive holiday agreement or excursion arranged through us we shall, at our discreation, offer advice and assistance to help you resolve any claim you may have against a third party, provided you tell us about the incident within 90 days ot ifs occurance.  Where legal action is contemplated our authority must be obtained prior to commencement of proceedings and be subject to you undertaking to assign any costs recovered or any benefits under an appropiate insurance policy to us.  Our costs in respect of the above on behalf of you and your party shall not exceed £5000 in total.

PASSPORTS, VISAS & JABS

14.  Holders of British passprts do not need a visa for Menorca.  If you do not have a full British passport, apply for one at least 5 weeks before departure.  If your passprt is not British, it is your responsibility to cheack what visas you need, though we will help you.  Your air ticket and passprt must bear the same name.  If the name of anuone in your party changes (eg through marriage) you must notify us and return any air ticket(s) already issued.  If the change cannot be effected in time, take your marriage certificate with you as proof.  An incorrect name may also invalidate your holiday insurance.  At the time of going to press, no inoculations are required for our brochured resorts by British citizens but we advise that you consult your doctor before travelling.  The department of health publishes leaflets containing advice to travellers on health which are available from your doctor or by telephoning FREEPHONE 0800 - 555 777.

FLIGHTS

15.  Whilst all our standard flights are daytime flights, at time of publication of this brochure full details of the flight programmes had not been finalised.  We can however, normally confirm times on enquiry although we also "tailor make" holidays by obtaining flights from provincial airports we do not feature or on a day of deparutre different from our normall flight programme.

SELF-CATERING CONDITIONS

16.  If is agreed that all the information under "Self-Catering Holdiays" on the information page forms part of the booking contract.

DISRUPTIVE BEHAVIOUR

17.  When you book a holiday with us you accept responsibility for the proper conduct of yourself and your party while on holiday.  We reserve the right to terminate your holiday or that of any member of your party due to misconduct.  If you actions or thoses of any member of your party cause damage to the accommodation in which you are staying or cause delay or diversion to any flight or other means of tranportation, you agree to fully indemnify us against any claim (including  legal costs) made against us by or on the owners of such accommodation or operator of such flight or other means of transportation.

CRUISING

18.  When the holiday includes a cruise we reserve the right to substitute another vessel for the one booked provided that it is the same standard or higher and the room style is the same or better.   Ships are mechanical and by their very nature can suffer delays or be taken out of service due to low bookings or for unforseen essentials repairs caused by events beyond the control of the operator.

BOOKING VIA AGENT

19.  Any money paid by customer to an agent i.e. pipe line money is at all times held on behalf of Celtic Line Travel Ltd.

CONSUMER PROTECTION

20.  The air holidays and flight in this brochure are ATOL protected, since we hold an Air Travel Organiser's licence granted by the Civial Aviation Authority.  Our ATOL 1772.  In the unlikely event of our insolvency, the CAA wil ensure that you are not standed abroad and will arrange to refund any money you have paid to us for an advance booking.  For further details information, please visit the ATOL web site: www.atol.org.uk
